Good Spirit d.o.o. as a service provider of the website thegoodspirit.eu (hereinafter referred to as Good Spirit) complies with the applicable regulations aimed at protecting the privacy of its Customers and Users, and in particular the General Regulation on the Protection of Personal Data of the EU. This document describes how the processing manager Good Spirit d.o.o. Čakovec, M. Krleže 28 (hereinafter Good Spirit d.o.o.) processes personal data.

Buyers of the Good Spirit website (hereinafter referred to as Buyers) or Users receiving information about Good Spirit products and promotions (hereinafter referred to as Users) are instructed to read everything stated on this page in order to better understand what information Good Spirit d.o.o. collects and processes, for what purpose, on the basis of which legal basis, with whom and why it is shared, which protective measures it implements, and what are your rights regarding access to personal data, correction, deletion and your right to object.

By accepting this Privacy Statement by clicking on the Customer's registration or logging in on the Good Spirit website by the User receiving information about Good Spirit's products and promotions, the Customer or the User confirms that they have read, understood and agree to the processing of personal data as determined by this Statement .

What type of personal data is collected and processed by Good Spirit d.o.o. through the website thegoodspirit.eu?

When registering a person as a Customer of the Good Spirit website, Good Spirit d.o.o. will ask the future Customer to provide certain information about himself (personal data), such as name and surname, address (including postal code), e-mail address, telephone number, date of birth (optional), username and password.

After a person registers as a Customer, he has the option to access the Loyalty Program located within the Customer's profile. Access to the Loyalty Program is not binding in any way. Good Spirit d.o.o. will ask the Customer for certain personal data when registering: Name and surname, address, city and postal code, phone number (optional), mobile phone number, date of birth and gender. The customer confirms that he agrees to the processing of personal data by clicking on the application button.

When registering a person as a User receiving information about products and actions of the Good Spirit Internet site, Good Spirit d.o.o. will ask the future User to enter information about himself (personal data), namely: name (optional) and e-mail address.

The provision of personal data is the decision of the Customer or User. If the Customer or User does not provide the requested mandatory information for a certain activity that requires it, he will not be allowed to participate in such an activity, because without this information the activity will not be technically feasible.

In addition to this data, we automatically collect data from your computer, which may include an IP address, and there are also situations in which we automatically collect other types of data, such as the date and time of access to the Good Spirit website, information about the hardware, software or Internet browser you use. as well as about your computer's operating system and application version and your language settings.

We may also collect information about clicks and Good Spirit pages that are shown to you. Good Spirit recommends that Customers take care of their login password for their Good Spirit website user account. We recommend that when choosing a combination of characters for the password, you should definitely combine upper and lower case letters and numbers, and that you should definitely use a password of at least six characters. We recommend changing the password periodically (at least once a year).

For what purpose does Good Spirit collect and process personal data?

Good Spirit collects and processes personal data of the Buyer of the Good Spirit.eu website for the purpose of conducting a secure authentication of Buyers who access the Good Spirit website, realization of contracts for the purchase of goods or services, delivery of goods to the Buyer, communication with the Buyer, possible legal procedures related to the implementation of the contract , and partly we also apply automated processing processes in order to constantly improve our processes in the interest of the Customers, to make the offer for the Customer more individual and to adapt our offer of products and services as much as possible to the habits and needs of the Customers. Good Spirit collects and processes personal data of Customers registered in the Loyalty Program for the purpose of creating personalized content through automated data processing processes.

Good Spirit collects and processes the personal data of the User who receives notifications about products and actions for the purpose of sending notifications, invitations to participate in prize competitions via e-mail, social networks or other communication channels to which you have previously registered, possible legal procedures related to the implementation of the contract , in order to create a user profile with the aim of receiving individual notifications, market research and improving the efficiency and quality of our services.

We do not collect information about children. If we become convinced that such information has been transmitted to us without the consent of the parents or guardians of children under 16 years of age, we will remove it without delay. Minors under the age of 16 may not use the Good Spirit Website. No part of the Good Spirit Website is designed to appeal to anyone under the age of 16.

What is the legal basis for processing personal data?

By entering his personal data and confirming (clicking) acceptance of the General Terms and Conditions of Business and this Privacy Statement, the customer enters into a contractual relationship that is the basis for the purchase of products and services of the customer's choice on the Good Spirit website, which is contained in the General Terms and Conditions of Business and is therefore, the processing of such personal data is legal because actions are taken at the request of the Customer for the purpose of realizing the purchase of products and services at the order of the Customer, and the concluded contract to which the customer is a party to the test. The customer who applies for the Loyalty Program, by entering his personal data and confirming (clicking on the Sign Up button), gives his consent to the processing of his personal data.

A user who registers to receive information about products and promotions by entering his data on the Good Spirit website and double confirming the correctness of his email address gives his consent to the processing of his personal data. The User can withdraw the consent at any time by sending a notification to the email address of the personal data protection officer uprava@thegoodspirit.eu.

With which recipients does Good Spirit share personal information?

Good Spirit will not share the personal data of the Customer or User with other parties except in the cases specified in the next point and in the situation when positive regulations require it.

Good Spirit will share the Customer's personal data with:

1. To service providers of distribution of goods with whom it has a permanent contract and for this purpose to fulfill orders, deliver packages, send ground mail and e-mail. The distribution service provider may ask the Customer for his/her identity card at the time of delivery of the package during the personal collection of the goods, all for the purpose of realizing the package delivery service and keeping records of who collected the package. If the Customer refuses to provide this information, the package will not be delivered.

2. To service providers of the authorized service in the event that the Customer files a complaint, advertises the product and needs a product inspection or requests servicing of the product he purchased, all for the purpose of realizing the service of repair, servicing or inspection of the product by the authorized service.

3. Sponsors of prize contests are in the process of handing over prizes to the prize winner, when Good Spirit, which is the prize contest organizer, indicates in the prize contest rules that the delivery of the prize to the winner will be organized by the sponsor.

4. Depending on the selected payment method (credit or debit card), the data required for payment will be forwarded to the contractual partners who execute the payment. The payment service provider collects data within its own card payment application, in which case the service provider's privacy notices apply. Good Spirit d.o.o. does not have access to the data required for payment, nor does it store them.

The transfer of your data to external payment service providers is based on Regulation (EU) 2016/679 of the European Parliament and of the Council - General Data Protection Regulation - GDPR, Article 6, paragraph 1, indent b - processing necessary for the conclusion and performance of the contract.

5. To the provider of information mediation services for electronic accounts, because Good Spirit d.o.o. pursuant to the Act on Electronic Issuing of Invoices in Public Procurement, the obligee of issuing e-invoices. For this purpose, it concluded a contract with an authorized service provider - an information intermediary through which the exchange of data takes place between the issuer and the recipient of the e-invoice of a legal entity, during which all invoices issued by Good Spirit to legal entities are processed and during which the publicly available contacts will be the customer, a legal entity, is contacted by an authorized Information Intermediation Service Provider, who will request the contact of the legal entity, the official email address, for the purpose of delivering electronic invoices. If that official address is designed to contain a personal name, the legal entity will assess whether or not to provide that contact.

Good Spirit at no time disposes, collects or processes personal data entered for the purpose of processing and charging cards.

Good Spirit stores the personal data of registered Customers of the Good Spirit website for the period while the purpose of the processing is achieved, which is the period until the moment when the registration is active and six months after the end of the Customer's registration, during which period any complaints from the previous period will be resolved. Good Spirit stores the personal data of registered Users receiving notifications about products and promotions for the period while the purpose of the processing is being achieved, which is the period until the moment when the registration is active.

The Customer and User can access their personal data at any time by registering on the site and by accessing "My Account" where the Customer can review their personal data that they have shared with Good Spirit. The Customer and User can request and receive from Good Spirit complete information about the personal data that is stored, as well as the correction of the same, by sending an e-mail message to the e-mail address of the personal data protection officer: uprava@thegoodspirit.eu

Deletion of personal data (right to be forgotten)

The customer and user have the right to request deletion of personal data at any time (right to be forgotten). The customer can do this by sending a request to the email address of the personal data protection officer uprava@thegoodspirit.eu and the data will be deleted without delay. The user has the option of submitting a request for deletion in every notification he receives from Good Spirit via e-mail, or he can send an e-mail message to the e-mail address of the personal data protection officer uprava@thegoodspirit.eu stating that his personal data is deleted.

The right to object

If, despite all the measures taken to protect personal data, you believe that you have grounds for a complaint, contact the personal data protection officer at uprava@thegoodspirit.eu.

Good Spirit takes data protection seriously and takes various precautions to protect personal data. Unfortunately, no data transmission over the Internet, or any wireless network, can be 100% secure. As a result, although Good Spirit implements reasonable data protection measures, it cannot guarantee the protection of any information transmitted to or from the Good Spirit website and is not responsible for the actions of any third party that receives such information. Good Spirit can decide to store personal data with service providers within the EU and only exceptionally outside the EU. This will only be done if there is a European Commission decision on adequacy for that country and if a guarantee and compliance with binding regulations on the protection of personal data has been agreed upon.
